Preambule

Loc'MyPlace is an online platform (hereinafter the "Service") accessible via the website https://locmyplace.be and the web application https://app.locmyplace.be. The Service is a project under development and is currently operated by the developers of the Loc'MyPlace project (hereinafter "Loc'MyPlace" or "We").

The Service is provided "as is," within the framework of an experimental development phase. Although We strive to ensure its proper functioning, Loc'MyPlace cannot guarantee a total absence of errors or malfunctions. The User acknowledges that the use of matchmaking platforms involves inherent risks related to human interactions and the reliability of information provided by third parties. The User is solely responsible for assessing these risks and the decisions they make based on the information obtained or the interactions arising from the use of the Service.

The purpose of the Service is to connect landlords of real estate seeking to rent (hereinafter the "Landlord") and individuals seeking rental housing (hereinafter the "Tenant"). Loc'MyPlace acts exclusively as a technical intermediary by providing the platform that enables this connection. Loc'MyPlace is in no way a party to the contractual relationships, negotiations, or agreements (including rental agreements) that may arise between Landlords and Tenants.

These Terms and Conditions of Use (hereinafter the "TCU") govern access to and use of the Service. By accessing or using the Service, you agree to be bound by these TCU. If you do not agree to all of these TCU, you are not authorized to use the Service.

Article 1 - Definitions

The terms beginning with a capital letter, in the singular or plural, have the following meaning in these TCU:

  • TCU: Refers to these Terms and Conditions of Use.

  • User Account: Refers to the personal space created by the User on the Web Application, allowing access to the functionalities of the Service.

  • Rental File: Refers to all the personal, professional, and financial information, as well as the documents (identity card, pay slips, etc.) uploaded by the Tenant on the platform.

  • Tenant: Refers to any natural or legal person using the Service for the purpose of searching for a property to rent.

  • Platform / Service: Refers to the Loc'MyPlace online platform, accessible via the website https://locmyplace.be and the web application https://app.locmyplace.be, including all its functionalities and content.

  • Rental Proposal: Refers to the notification sent by an Landlord to a selected Tenant via the Service, providing access to the property's photos and allowing the Tenant to request a visit or formally apply.

  • Landlord: Refers to any natural or legal person using the Service for the purpose of offering a property for rent.

  • User: Refers collectively to the Landlord and the Tenant, or any person accessing or using the Platform.

Article 2 - Access to and Registration for Services

2.1. Access Conditions Access to and use of the Loc'MyPlace Service is reserved for natural persons who are at least eighteen (18) years of age and have the full legal capacity to enter into contracts. The User declares and warrants that they have the legal age and necessary legal capacity to use the Service in accordance with these Terms and Conditions of Use (TCU).

2.2. User Account Creation Access to the Web Application https://app.locmyplace.be and its functionalities requires the creation of a User Account. During registration, the User agrees to provide accurate, complete, and up-to-date information, and to keep it updated. Loc'MyPlace reserves the right to suspend or terminate a User Account if the information provided is false, inaccurate, incomplete, or outdated.

2.3. Login Credentials The User is responsible for maintaining the confidentiality and security of their login credentials. They agree not to disclose them to third parties. Loc'MyPlace shall not be held liable for any consequences arising from the use of the User Account by a third party following negligence on the part of the User. In the event of unauthorized use of their account, the User agrees to notify Loc'MyPlace immediately.

Article 3 - Operation of Services and Information Sharing

3.1. Process for the Tenant:

  • The Tenant creates a User Account and enters the criteria for their rental request (location, number of rooms, etc.) and some basic personal information (maximum budget, availability, etc.).

  • The Tenant may, optionally, complete their Rental File by providing more detailed information and uploading documents. This Rental File remains private and is not accessible to Landlords at this stage.

  • When a Rental Proposal is sent by an Landlord, the Tenant can then view the photos of the property in question.

  • If interested, the Tenant can request a visit via the Platform. At this time, Loc'MyPlace shares the Tenant's contact details (email address and phone number if provided) with the relevant Landlord so that they can arrange the visit outside of the Platform.

  • After the visit (or if interested following the Rental Proposal), the Tenant has the option to formally submit their application for the rental of the property via the Platform. By submitting their application, the Tenant explicitly consents to the sharing of their entire Rental File (including sensitive information and confidential documents) with the specific Landlords who owns the property for which the Tenant is applying to rent. This sharing is clearly indicated to the Tenant at the time of submitting their application.

3.2. Process for the Landlord:

  • The Landlord creates a User Account and posts one or more property listings for rent, including descriptions and photos.

  • The Landlord receives a list of Tenants whose rental requests match the criteria of their property. For each candidate, the Landlord has access to the following limited information: first name, last name, maximum budget, availability, and the completion status of their Rental File. The Landlord does not have access to the content of the Rental File at this stage.

  • The Landlord can select candidates and send them a Rental Proposal via the Platform; the Landlord's first and last name are then transmitted to the candidate Tenant.

  • If a selected Tenant requests a visit, the Tenant's contact details (email and phone number if provided) are transmitted to the Landlord via the Platform for the planning of the visit.

  • The Landlord has access to the entire Rental File of a Tenant only if and when that Tenant has formally applied for their property after receiving the Rental Proposal and requesting a visit (or decided to apply directly following the Rental Proposal).

3.3. Nature of Information Sharing: The User understands and agrees that the proper functioning of the Service involves the sharing of information (potentially including personal data) with other Users, according to the progressive process described above. Loc'MyPlace cannot be held responsible for the use that other Users make of the information legally transmitted to them via the Service in accordance with these TCU and the Privacy Policy. It is the User's responsibility to assess the reliability of the information provided by other Users and to make their decisions accordingly.

Article 4 - User Obligations

4.1. General Obligations: The User agrees to use the Service in a fair, legal manner, in accordance with its intended purpose and these Terms and Conditions of Use (TCU). The User specifically agrees not to:

  • Use the Service for illegal, fraudulent, or unauthorized purposes.

  • Infringe upon the rights of Loc'MyPlace or other Users.

  • Attempt to gain unauthorized access to Loc'MyPlace's computer system or disrupt its operation.

  • Use the Service to transmit illegal, defamatory, insulting, hateful, racist, discriminatory, pornographic, or violent content.

  • Transmit viruses or any other harmful elements.

  • Engage in spamming or the mass sending of unsolicited messages.

4.2. Specific Obligations of Landlords: The Landlord agrees to provide accurate, complete, and non-misleading information regarding the properties they offer for rent. They guarantee that they have the necessary rights to rent the property and publish the corresponding photos and descriptions. The Landlord agrees to comply with all applicable laws, including, but not limited to, legislation relating to non-discrimination in housing, in the selection of and interaction with prospective tenants.

4.3. Specific Obligations of Tenants: The Tenant agrees to provide accurate, complete, and sincere information when creating their request and, where applicable, when filling out their Rental File. They certify the authenticity of the documents they upload. The Tenant understands that the limited information initially shared with Landlords (first name, last name, budget, etc.) is intended to allow for an initial selection, and that the sharing of their complete Rental File, including sensitive data, is conditional upon their explicit consent at the time of applying for a specific property.

4.4. Reporting Inappropriate Content or Abuse: Any User may report to Loc'MyPlace any inappropriate content, abusive behavior, or any alleged violation of these TCU or the law by another User, by contacting Loc'MyPlace by email at: support@locmyplace.be. Loc'MyPlace will endeavor to examine reports as soon as possible, without however guaranteeing a particular outcome or being held to a general obligation to monitor content or behavior.

Article 5 - Loc'MyPlace's Liability

5.1. Intermediary Role: Loc'MyPlace acts exclusively as a provider of a technical platform for connecting users. We are not a real estate agency, real estate agent, representative, or advisor in real estate transactions. We do not intervene in any way in the negotiation, conclusion, execution, or termination of lease agreements or any other agreements between Users.

5.2. Absence of Control Over User Content: Loc'MyPlace does not systematically and exhaustively verify the accuracy, reliability, legality, or compliance of property listings, descriptions, photos, personal information, professional or financial information, or documents (including Rental Files) provided by Users. Each User is solely responsible for the content they publish or share via the Platform.

5.3. Limitation of Liability: To the extent permitted by applicable law, Loc'MyPlace shall in no event be liable for:

  • Inaccuracies, errors, or omissions in the information provided by Users.

  • Direct or indirect damages resulting from interactions between Users (visits, negotiations, etc.).

  • Direct or indirect damages resulting from the conclusion or non-conclusion of a lease agreement or any other agreement between Users.

  • Disputes, claims, or damages arising from the relationships between Users.

  • The violation by a User of applicable laws or regulations (including, but not limited to, anti-discrimination laws).

  • Direct or indirect damages suffered by the User or a third party due to the use or inability to use the Service, except in the case of proven gross negligence or willful misconduct on the part of Loc'MyPlace.

  • Problems or incidents occurring during visits or outside the Platform.

  • The use that other Users make of the information legally shared with them via the Service.

The User acknowledges that Loc'MyPlace is only bound by an obligation of means regarding the provision and operation of the Service.

Article 6 - Availability of the Service

The Service is provided on an "as is" basis, and its availability is not guaranteed. Loc'MyPlace strives to ensure maximum availability of the Platform but cannot guarantee continuous and uninterrupted operation. Access to the Service may be temporarily suspended, limited, or interrupted at any time, without prior notice or compensation, particularly for reasons of maintenance, updates, technical failures, or force majeure. Loc'MyPlace shall not be held liable for the consequences of such interruptions for the User.

Article 7 - Intellectual Property

7.1. Loc'MyPlace's Property: All elements constituting the Service (website, web application, structure, texts, graphics, images, sounds, logos, databases, software, etc.), with the exception of content provided by Users, are the exclusive property of Loc'MyPlace or are subject to a usage license granted to Loc'MyPlace. These TCU do not grant the User any intellectual property rights over all or part of the Service, other than a limited and non-exclusive right of use in strict compliance with the TCU.

7.2. User Content: The User retains ownership of all content (texts, descriptions, property photos, Rental Files, documents, etc.) that they upload, publish, or share via the Service.

By uploading, publishing, or sharing content on the Service, the User grants Loc'MyPlace a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license, for the duration of their User Account, to host, store, reproduce, display, publish, adapt, modify, and distribute this content for the sole purpose of providing and operating the Loc'MyPlace Service in accordance with these TCU and the Privacy Policy.

This license is strictly limited to the actions necessary for the normal operation of the Platform (for example, displaying photos of a listing to eligible Tenants, allowing the download of a Rental File by an authorized Landlord).

The User warrants that they have all the necessary rights and permissions to the content they publish to grant this license to Loc'MyPlace. They agree not to publish any content that would infringe the intellectual property rights or any other rights of third parties.

Article 8 - Personal Data

The processing of Users' personal data collected in connection with the use of the Service is governed by Loc'MyPlace's Privacy Policy. This document, which forms an integral part of these TCU, describes how Loc'MyPlace collects, uses, processes, and protects your personal data, as well as your rights in accordance with the General Data Protection Regulation (GDPR).

By accepting these TCU, you also accept the Privacy Policy.

Article 9 - Cookies

Loc'MyPlace uses cookies and similar technologies on its Platform. These technologies contribute to the proper functioning of the Service, the analysis of its use, and the improvement of the User experience.

For complete information on the types of cookies used, their purposes, their retention period, and how the User can manage their cookie preferences, the User is invited to consult Loc'MyPlace's privacy policy: https://locmyplace.be/en/privacy-policy.

By using the Service, the User accepts the use of cookies in accordance with this document.

Article 10 - Account Suspension and Termination

10.1. By the User: The User may request the deletion of their User Account at any time. For the time being, this request must be made by contacting Loc'MyPlace by email at: support@locmyplace.be. The deletion of the account will result in the deactivation of access to the Service. The fate of the User's data and content following the deletion of their account is detailed in the Privacy Policy.

10.2. By Loc'MyPlace: Loc'MyPlace reserves the right to temporarily suspend or permanently terminate the User Account unilaterally, without prior notice or compensation, in the event of a serious and/or repeated violation by the User of these TCU, applicable law, or if the User's behavior harms the proper functioning of the Service or prejudices Loc'MyPlace or other Users. Termination takes effect immediately or after sending a notification (depending on the severity of the breach).

Article 11 - Modification of the Terms and Conditions of Use

Loc'MyPlace reserves the right to modify these TCU at any time, particularly to adapt to changes in the Service, technology, legal requirements, or for commercial reasons. The User will be informed of modifications by email to the address associated with their User Account. The modifications will take effect on the date specified in the notification. By continuing to use the Service after the modifications come into effect, the User is deemed to have accepted the new TCU. If the User does not accept the modifications, they must cease using the Service and request the deletion of their User Account.

Article 12 - Miscellaneous Provisions

12.1. Non-Waiver: The fact that Loc'MyPlace does not immediately invoke a provision of these TCU shall not be interpreted as a waiver of its right to invoke it subsequently.

12.2. Partial Invalidity: If one or more provisions of these TCU are held to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed unwritten to the extent of its invalidity or unenforceability, and the remainder of the TCU shall remain in full force and effect.

12.3. Entire Agreement: These TCU, supplemented by the Privacy Policy, constitute the entire agreement between the User and Loc'MyPlace relating to the use of the Service, and supersede any prior agreement, whether oral or written, relating to the same subject matter.

Article 13 - Governing Law and Jurisdiction

These Terms and Conditions of Use are governed by and construed in accordance with Belgian law.

Any dispute relating to the validity, interpretation, or execution of these TCU shall be subject to the exclusive jurisdiction of the courts of the judicial district of Brussels, Belgium.
