Preambule
The protection of your personal data is a priority for Loc'MyPlace. We are committed to processing your data with respect for your privacy and in accordance with the applicable legal provisions regarding the protection of personal data, in particular the General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter "GDPR") and the Belgian legislation in force.
The purpose of this document is to inform you clearly and transparently about how Loc'MyPlace, as the data controller, collects, uses, shares, transfers, and protects your personal data when you use our Service, accessible via the website https://locmyplace.be and the web application https://app.locmyplace.be.
Identification of the Data Controller:
For the processing of personal data covered by this Policy, the data controller is Loc'MyPlace.
Current Situation: In the current absence of a formal legal structure for the Loc'MyPlace project, the data controllers are the project developers. The contact details are those indicated in the "Contact" section of this Policy.
Future Update: As soon as the legal structure of the Loc'MyPlace project is formalized (creation of a company), this section will be updated with the legal name, the address of the registered office, and the complete contact details of the entity responsible for processing, in accordance with legal requirements.

By using our Service, you acknowledge that you have read and understood the terms of this Policy.
Article 1 - Definitions
For the purposes of this Privacy Policy, terms and expressions not defined below shall have the meaning given to them in the Loc'MyPlace Terms and Conditions of Use: https://locmyplace.be/en/terms-and-conditions.
In addition, the following definitions apply:
Personal Data: Any information relating to an identified or identifiable natural person (hereinafter referred to as "data subject"). An "identifiable natural person" is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
Processing: Any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
Data Controller: The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the Processing. For the purposes of this Policy, the Data Controller is identified in the Preamble.
Article 2 - Data collected
We collect personal data about you in various ways when you use our Service:
2.1. Data you provide to us directly
This is the data that you actively communicate to us when you create your User Account, complete your profile, use the features of the Service, or communicate with us. This data may include:
Identification and contact information: Your first name, last name, email address, and potentially your phone number if you choose to provide it. This information is necessary to create and manage your User Account and enable communication.
Rental search information (for Tenants): Your property search criteria (e.g., property type, desired location, number of bedrooms) and your maximum rental budget, your availability to move in.
Rental File Information and Documents (for Tenants - optional): If you choose to complete your Rental File, you provide us with more detailed and potentially sensitive information, such as: Identity information (copy of identity card/passport) Proof of income (copy of payslip, allowances, etc.) Certificate of household composition Any other information or document you choose to include to support your application.
Attention: The Rental Application File contains data considered sensitive under the GDPR (financial data, identity documents). We process this data with particular attention, solely for the explicit purposes of facilitating your application if you choose to submit your application and with your specific consent at that time.
Property listing information (for Landlords): Detailed description of the property, address, characteristics, rental conditions, and photos of the property.
Communications with our support: The content of the messages you send us (for example, via email) when you contact us for help, ask a question, or report a problem.
2.2. Data we collect automatically when you use the Service
Some data is collected automatically when you access and use the Platform, even without logging in or actively providing information. This data may include:
Connection and usage data: Information about how you access and use the Service, such as your IP address (which may indicate your approximate location), the type of browser and operating system you use, login dates and times, pages viewed, features used, and actions taken on the Platform (e.g., creating a rental request, clicking on a rental proposal, sending a proposal). This data is collected via our servers and the tools of our technical service providers (such as Google Cloud Platform).
Data collected via Cookies and similar technologies: As explained in Article 9 of the Terms and Conditions of Use, we use cookies and other technologies to collect information about your browsing behavior and use of the Service.
Article 3 - Purposes of data processing
We collect and use your Personal Data exclusively for the specific purposes below, based on the legal grounds provided for by the GDPR.
3.1. Provision and management of the Loc'MyPlace Service
Purposes: Creating and managing your User Account; allowing you to access the features of the Service; for Tenants, managing your rental request and your Rental File; for Landlords, managing your listings; connecting Tenants and Landlords according to the process described in the Terms and Conditions of Use (including the initial sharing of limited information and the sharing of contact details for viewing requests); facilitating communications initiated by you via the platform (excluding the explicit sharing of the Rental File).
Data concerned (mainly): Identification and contact information, Rental search information, Property listing information, Connection and usage data related to accessing features.
Legal basis: Performance of a contract (Article 6(1)(b) of the GDPR). The processing of this data is necessary to execute the Terms and Conditions of Use that you accept by using the Service, in order to provide you with the promised functionalities.
3.2. Sharing specific information with your consent
Purpose: Sharing your entire Rental Application File with a specific Owner when you, as a Tenant, formally submit your application for a property via the Platform after receiving a Rental Proposal. Use of certain types of cookies not strictly necessary for the operation of the site.
Data concerned (mainly): Information and documents of the Rental Application File (including sensitive data), certain Data collected via Cookies.
Legal basis: Your explicit consent (Article 6(1)(a) and, for the sensitive data in the Rental Application File, Article 9(2)(a) of the GDPR). The sharing of the Rental Application File is only done with your clear and active agreement when submitting your application for a property. For non-essential cookies, your consent is collected via the banner or the cookie management tool. You have the right to withdraw your consent at any time for these processing operations (see Article 8).
3.3. Improvement of our Services and Security
Purposes: Analyzing the use of the Service to understand how it is used and to improve it (developing new features, optimizing the interface, etc.); ensuring the technical security of the Platform, detecting and preventing fraud, abuse, security incidents, and violations of our Terms and Conditions of Use; carrying out necessary technical maintenance.
Data concerned (mainly): Connection and usage data (often used in aggregate or anonymized form), certain Data collected via Cookies.
Legal basis: Our legitimate interest (Article 6(1)(f) of the GDPR). It is in our legitimate interest to ensure the proper functioning, security, and continuous improvement of the Service we offer. We ensure that this legitimate interest does not disproportionately affect your fundamental rights and freedoms.
3.4. Communications related to the Service and Support
Purposes: Sending you important notifications related to the operation of the Service (e.g., message notification, proposal received, viewing request, technical alerts); informing you of important updates to the Terms and Conditions of Use or this Privacy Policy; responding to your questions and requests when you contact our support.
Data concerned (mainly): Identification and contact information, Content of communications with our support, Connection and usage data (for context).
Legal basis: Our legitimate interest (Article 6(1)(f) of the GDPR) for communications necessary for the proper use of the Service and support responses, or Performance of a contract (Article 6(1)(b) of the GDPR) when the communication is an integral part of the promised Service.
3.5. Compliance with our legal and regulatory obligations
Purpose: Responding to legal requests from competent authorities (administrative, judicial, tax, etc.) when we are legally obliged to do so; complying with any other legal or regulatory obligations incumbent upon us as the operator of the Service.
Data concerned: All Personal Data held by Loc'MyPlace, to the extent strictly necessary to comply with the legal obligation.
Legal basis: Legal obligation (Article 6(1)(c) of the GDPR). The processing is necessary for compliance with a legal obligation to which Loc'MyPlace is subject.
Article 4 - Data sharing
In the context of operating the Service and for the purposes described in Article 3, your personal data may be shared with the following categories of recipients:
4.1. With other Users of the Platform: Data sharing between Users is at the heart of how Loc'MyPlace works, but it is done progressively and controlled, as described in detail in Article 3 of the Terms and Conditions of Use and summarized here:
For Landlords: They receive limited information from Tenant applicants (first name, last name, maximum budget, availability, and completion status of the Rental Application File). If a Tenant requests a visit, the Owner also receives the Tenant's contact details (email and phone number if provided). Finally, if the Tenant formally applies for the listing, the Owner receives the Tenant's entire Rental Application File.
For Tenants: They view the rental proposals sent by Owners in their listings (Owner's first and last name, description, characteristics, photos). If the Tenant requests a visit, their contact details are then transmitted to the Owner to schedule a viewing.
Attention: Loc'MyPlace does not control how other Users use the personal data that is legally shared with them via the Platform. It is the User's responsibility to exercise caution in the information they choose to share and in their interactions.
4.2. With our service providers (Processors): We use third-party service providers acting on our behalf and under our instructions, as "processors" within the meaning of the GDPR, to help us provide and operate the Service. They only have access to your personal data to the extent strictly necessary for the performance of their services and are contractually bound to its security and confidentiality.
Our main processors, classified by the type of service they provide to us, include:
Hosting of the presentation website (https://locmyplace.be):
Hostinger: For the technical hosting of our showcase website. As part of this service, only technical access and connection data (such as your IP address, date and time of visit) are processed, mainly via server logs necessary for the proper functioning and basic security of the site. The servers used for this hosting are located in the United States.
Hosting and distribution of the web application (https://app.locmyplace.be):
Google Cloud Platform: For hosting the web application, this service uses a global content delivery network (CDN) to serve the application quickly. Only data ensuring the operation of the application (internal) may be processed (logo, fonts, etc.). This involves processing data on origin servers (located in the United States) and on cache servers distributed worldwide, including in Europe.
Secure database:
Google Cloud Platform: For the secure storage of your account information and structured data necessary for the operation of the application (e.g., listing descriptions excluding photos, search criteria, internal platform messages). This data is stored on servers located in Belgium (Saint-Ghislain, Walloon Region, Province of Hainaut).
Secure file storage:
Google Cloud Platform: For the highly secure hosting of files and documents you upload, including property photos and, particularly importantly, the elements of the Rental File. This data, which may contain sensitive or critical information, is stored on servers located in Belgium (Saint-Ghislain, Walloon Region, Province of Hainaut). We emphasize the security (encryption, etc.) of this locally hosted data. This is the only service that is required to store, transmit, and facilitate the transmission of sensitive documents (Rental File).
Secure cloud infrastructure:
Google Cloud Platform: To ensure the operation and availability of the platform, the servers used are located in Belgium (Saint-Ghislain, Walloon Region, Province of Hainaut). These services do not permanently store data. They temporarily process various data necessary for the operation of the application (account information, search criteria, data related to non-sensitive listings or applications) by interacting with the database and the file storage service. It is important to note that sensitive data directly stored in the Secure Storage (notably the elements of the Rental File) does not pass through these servers at any time.
Authentication service:
Google Cloud Platform: For managing your User Account and authentication processes. The data managed by this service (your email address, phone number if provided, connection metadata) is processed and stored in the United States.
Email sending service:
SendGrid (Twilio): For sending transactional emails (and in the future, notifications, information, etc.). Sending these emails involves the processing of your email address and the content of the message on SendGrid's servers in the United States.
4.3. With competent authorities: We may be required to disclose your personal data to competent administrative, judicial, or tax authorities when such disclosure is required by law, regulation, legal or administrative proceedings, or to protect our rights or those of third parties.
Article 5 - Data transfers outside the European Union
We wish to inform you that, in the context of using the services of some of our processors listed in Article 4.2 (notably Hostinger, Google for certain services, and SendGrid), your Personal Data is transferred to countries located outside the European Economic Area (EEA), particularly to the United States, and potentially to other countries via global content delivery networks (CDNs).
These transfers are necessary to ensure the technical operation of the Service (hosting, authentication, sending emails, distribution of the web application).
In accordance with Chapter V of the GDPR, we ensure that any transfer of Personal Data to a country outside the EEA benefits from appropriate safeguards to ensure a level of protection substantially equivalent to that offered within the EEA. These safeguards may include, depending on the provider and the service concerned:
Standard Contractual Clauses (SCCs): We rely on the Standard Contractual Clauses adopted by the European Commission (or equivalent contractual commitments offering similar safeguards and provided for in the DPAs of our processors) as a legal framework to govern the transfer of personal data to third countries. These clauses impose strict obligations on the data recipients to protect your rights and freedoms. Links to the Data Processing Addendums (DPAs) of our main processors (which generally incorporate these SCCs) are provided in Article 4.2.
The EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF: For transfers to the United States, when our processors are certified under these frameworks, we may rely on this certification as a transfer mechanism, in addition to or in combination with the SCCs. These frameworks, recognized by the European Commission, the United Kingdom, and Switzerland respectively, provide for strict commitments for certified U.S. companies regarding the protection of personal data. We invite you to consult the official website of the Data Privacy Framework to verify the certification status of our U.S. processors.
We select our processors by ensuring that they offer sufficient guarantees regarding the implementation of appropriate technical and organizational measures to protect your data, particularly in the context of transfers outside the EEA, in accordance with the requirements of the GDPR.
Article 6 - Data retention period
We retain your Personal Data only for the period necessary to achieve the purposes for which it was collected (listed in Article 3), as well as to comply with our legal obligations or resolve any potential disputes.
The retention period of your data depends on the category of data concerned and the purpose of the processing. Here are the general principles we apply:
User Account Data: We retain data related to your User Account (first name, last name, email, phone number) as long as your account is active. You can request the deletion of your User Account at any time by contacting us (see Article 10). Currently, account deletion is processed manually upon your request. Upon deletion of your account, your personal data is erased or irreversibly anonymized, with the exception of data that we are legally obliged to retain for a specific period or that is necessary for the establishment, exercise, or defense of legal claims.
Rental File Information and Documents: The data and documents you upload to your Rental File are retained as long as your Tenant Account is active and you do not delete them from your File. As this data is sensitive, it is managed with particular vigilance. If your User Account is deleted, the elements of your Rental Application File are treated like your other account data (erasure or anonymization, except for limited legal retention obligations or necessity for legal reasons).
Listing Information (Landlords): Information about your properties is retained as long as your Landlord Account is active. If your User Account is deleted, this data is erased or anonymized, except for limited legal retention obligations or necessity for legal reasons.
Communication and Support Data: Exchanges you have with our support may be retained for a limited period after the resolution of your request to allow us to follow up and improve our services (generally no more than 1 year, unless the conversation needs to be kept longer for legal proof purposes).
Connection and Usage Data: Technical logs and connection data are kept for a limited period necessary for the security and maintenance of the Platform (generally a few months). Usage data used for analysis purposes is anonymized or aggregated as soon as possible so that it no longer allows you to be identified.
Cookies: The retention period of cookies varies depending on their type. Details are specified in our dedicated section (see Article 10).
When your personal data is no longer necessary for the purposes for which it was collected or to comply with a legal obligation, we proceed with its secure deletion or irreversible anonymization.
Clarifications on legal retention or retention for legal reasons:
In some cases, even after a request to delete your account, we may be legally obliged to retain certain information about you for a limited period. This includes, for example:
The retention of technical security logs necessary for the detection and prevention of unauthorized access, fraud, or security incidents (for a limited period).
The retention of data necessary to respond to requests from competent authorities (administrative, judicial, police) in the context of legal proceedings.
The retention of data necessary for the establishment, exercise, or defense of legal claims, including proof of your acceptance of these Terms and Conditions of Use and the Privacy Policy, as well as proof of your consent to specific processing for which it is required (such as the sharing of your Rental File).
This data is kept secure and is only used within the strict framework of the legal obligations or legal necessities justifying its retention beyond the deletion of the account.
Article 7 - Your data, your rights
In accordance with the General Data Protection Regulation (GDPR), you have several rights regarding your Personal Data that we process. We are committed to facilitating the exercise of these rights. Your main rights are as follows:
Right of access (Article 15 GDPR): You have the right to obtain from Loc'MyPlace confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, access to the personal data and a copy thereof. You also have the right to obtain various information concerning this processing (purposes, categories of data, recipients, envisaged retention period, the existence of your other rights, the source of the data, the existence of automated decision-making, etc.).
Right to rectification (Article 16 GDPR): You have the right to obtain from Loc'MyPlace, without undue delay, the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to have incomplete personal data completed, including by means of providing a supplementary statement.
Right to erasure ("right to be forgotten") (Article 17 GDPR): In certain cases (for example, if the data is no longer necessary in relation to the purposes for which it was collected, if you withdraw your consent and there is no other legal basis for the processing, or if you object to the processing), you have the right to obtain from Loc'MyPlace the erasure of your personal data without undue delay. This right is not absolute and may be limited if the processing is necessary, for example, to comply with a legal obligation or for the establishment, exercise, or defense of legal claims (as detailed in Article 6 of this Policy).
Right to restriction of processing (Article 18 GDPR): You have the right to obtain from Loc'MyPlace restriction of processing in certain cases (for example, if you contest the accuracy of your data, if the processing is unlawful and you oppose its erasure, if you need your data for the establishment, exercise, or defense of legal claims even though we no longer need it for the purposes of the processing, or if you have objected to processing pending the verification of the legitimate grounds).
Right to data portability (Article 20 GDPR): Where the processing is based on consent or on a contract, and the processing is carried out by automated means, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format. You also have the right to transmit this data to another controller without hindrance from Loc'MyPlace.
Right to object (Article 21 GDPR): You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on our legitimate interest (see Article 3). In this case, we will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.
Right to withdraw your consent (Article 7(3) GDPR): Where the processing of your personal data is based on your consent (see Article 3.2, for example, for the sharing of the Rental Application File), you have the right to withdraw that consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
Right to lodge a complaint: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR. In Belgium, the supervisory authority is the Data Protection Authority (Autorité de Protection des Données - APD).
Article 8 - Exercising your rights
To exercise any of the rights mentioned in Article 7 (right of access, rectification, erasure, etc.) or for any questions regarding your rights and your Personal Data, you can contact us:

Your request must clearly indicate which right(s) you wish to exercise.
Verification of your identity:
To protect your Personal Data and prevent any unauthorized disclosure or modification, we will take reasonable steps to verify your identity when you exercise your rights. We may ask you to provide the necessary information to confirm that you are indeed the data subject of the request (for example, the email address associated with your User Account, or other information that allows us to cross-reference with your account without requesting unnecessary sensitive data).
Processing your request:
We will process your request as soon as possible and in any event within one (1) month of receipt of your complete and verified request. This period may be extended by a further two (2) months, taking into account the complexity and number of requests; in this case, we will inform you of this extension and the reasons for the delay within the initial one-month period.
Note regarding the current process:
Currently, the exercise of your rights (including account deletion requests) is handled manually by our teams upon receipt of your email.
Article 9 - Security of your data
We attach great importance to the security of your Personal Data and are committed to taking all appropriate technical and organizational measures to protect it against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or illegal access.
9.1. Security Measures
We take the following measures, without limitation:
Infrastructure Security: We rely on recognized cloud infrastructure providers (notably Google Cloud Platform) that implement robust physical, network, and organizational security measures to protect their data centers and services. Your critical data, such as the elements of your Rental File, is specifically stored in a secure storage service located in Belgium.
Communication Security: All communications between your browser/device and our servers, as well as within our platform, are encrypted via the HTTPS protocol to protect the confidentiality of exchanged data.
Access Controls: Access to your Personal Data by our team (the developers of the Loc'MyPlace project) is strictly limited to individuals who need access for the operation and maintenance of the Service and is protected by authentication measures.
Authentication Security: We use secure authentication services to manage access to your User Account and protect your credentials.
Secure Retention: Data is stored securely, and measures are taken to minimize its retention beyond what is necessary (see Article 6).
Despite our constant efforts to protect your data, it is important to remember that no method of transmission over the Internet or electronic storage is completely infallible. Therefore, we cannot guarantee absolute security.
9.2. Management of Personal Data Breaches
In accordance with our commitment to protect your Personal Data, we have implemented procedures to detect, assess, and respond to personal data breaches.
In the event of a personal data breach likely to result in a risk to the rights and freedoms of natural persons, we undertake to:
Notify the competent Data Protection Authority (APD) in Belgium of this breach without undue delay and, where feasible, not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons. This notification will describe, in particular, the nature of the breach, the categories and approximate number of data subjects concerned, the categories and approximate number of personal data records concerned, the likely consequences of the breach, and the measures taken or proposed to be taken to address the breach and, where appropriate, to mitigate its possible adverse effects.
Communicate the personal data breach to the data subject without undue delay when that breach is likely to result in a high risk to the rights and freedoms of natural persons. This communication will describe, in clear and plain language, the nature of the personal data breach and will contain the necessary information and recommendations. Communication to the data subject is not required if one of the conditions provided for in Article 34 of the GDPR is met (for example, if the data was protected by appropriate technical measures such as encryption, if subsequent measures ensure that the high risk is no longer likely to materialize, or if it would involve disproportionate effort – in which case a public communication or similar measure will be made).
We internally document all personal data breaches, including the facts relating to the breach, its effects, and the remedial action taken, to enable us to verify compliance with our legal obligations.
Article 10 - Cookies and similar technologies
Loc'MyPlace uses cookies and other similar tracking technologies (such as tags, markers, or pixels that collect information about your interaction with the Service) on its showcase website (https://locmyplace.be) and its web application (https://app.locmyplace.be).
What are cookies and other similar technologies? A cookie is a small text or data file downloaded and stored on your device (computer, tablet, smartphone, etc.) when you visit our Service. It allows the issuer of the cookie to recognize your device and remember certain information or preferences. Other similar tracking technologies, such as tags or pixels, are small snippets of code or images that allow information about your visit or behavior to be collected.
Why do we use these technologies and what categories? We use these technologies for several purposes, grouped into different categories:
Strictly necessary/technical cookies and technologies: These are essential for the proper technical functioning and basic security of the Service and to enable you to use its features. They relate to security (e.g., anti-bot protection) and the storage of your essential preferences (such as your cookie choices). Your consent is generally not required for these elements as they are essential for the provision of the service you explicitly request.
Analytical/performance cookies and technologies: These help us understand how Users interact with our Service (showcase website and web application), analyze traffic, measure audience, and improve the performance of the Platform. The use of these elements to collect data for audience analysis purposes requires your prior consent.

Article 11 - Changes to the privacy policy
This Privacy Policy may be modified at any time by Loc'MyPlace, in particular to adapt to changes in the Service, technologies, legal requirements, or data processing practices.
We will inform you of any substantial changes to this Privacy Policy by sending an email to the address associated with your User Account. The changes will take effect on the date specified in the notification or in the new version of the Policy.
We encourage you to regularly consult this Privacy Policy to be aware of any updates. The date of the last update is indicated at the top of the document.
Article 12 - Contact
